Kinder Island – Terms & Conditions

These Terms & Conditions ("Terms") apply to all visitors who book, attend, or participate in any activities at Kinder Island ("the Venue"). By using our services, you confirm you have read, understood, and agreed to these Terms.

Where bookings are made online, these Terms form a distance contract governed by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

1. About Kinder Island

1.1 Kinder Island is a family learning space designed for children aged 0–4 years and 4+ offering soft and creative ply, play-based, and class-led experiences.

1.2 All children must be accompanied and actively supervised at all times by a parent or responsible adult (aged 18 or over).

1.3 All visitors are required to follow venue guidelines and staff instructions to ensure a safe environment for everyone.

1.4 Kinder Island reserves the right to refuse entry or request that guests leave where behaviour is unsafe, disruptive, or disrespectful. This does not affect your statutory rights.

1.5 Kinder Island operates in accordance with the Equality Act 2010. We welcome all families and will make reasonable adjustments to support visitors with disabilities. Please contact us in advance if you require assistance.

2. Activities & Session Scheduling

2.1 Activities and classes are offered in accordance with age guidelines stated in the programme. These guidelines exist for safety and developmental reasons.

2.2 All sessions require advance online booking. Walk-in visitors are accepted subject to capacity on arrival. Walk-in entry cannot be guaranteed

2.3 Entry is permitted from the scheduled start time only. Early entry is not available.

2.4 Late arrivals will not receive extended time. No compensation or credit will be issued for time missed due to late arrival.

2.5 Guests must vacate the space promptly at the end of each session to allow for cleaning and preparation for the next group.

2.6 Any damage caused by misuse of materials, equipment, or the space may result in a reasonable request for compensation, assessed on a case-by-case basis.

3. Classes & Participation

3.1 All classes are parent-and-child experiences. A parent or guardian must remain with and actively supervise their child throughout the entire session.

3.2 Each class runs for approximately 45 minutes, depending on the activity type. Timing may vary slightly.

3.3 Classes are delivered by experienced educators or creative partners committed to safe, engaging, and imaginative learning.

3.4 Where a session includes outdoor learning activities, the activity type is clearly described at the point of booking. By completing a booking, the parent or legal guardian confirms they have read the session description and consent to their child participating in the outdoor learning activities stated.

4. Bookings & Payments

4.1 All bookings must be made through our online booking system.

4.2 A booking is confirmed only once full payment has been received and a confirmation has been issued to you.

4.3 Unless otherwise stated, full payment is required at the time of booking.

5. Cancellations, Refunds

5.1 Your Legal Rights (Consumer Contracts Regulations 2013) Where you book online, you have the right to cancel within 14 days of booking, unless the session is scheduled to take place within that 14-day period, in which case your right to cancel ends when the session begins. This is in accordance with Regulation 28(1)(h) of the Consumer Contracts Regulations 2013.

5.2 By completing a booking for a session scheduled within the 14-day cooling-off period, you expressly acknowledge and agree that your right to cancel is waived once the session commences.

5.3 In the event that Kinder Island cancels a session, you will receive a full refund.

5.4 These terms do not affect your statutory rights under the Consumer Rights Act 2015. If a service is not provided with reasonable care and skill, you may be entitled to a remedy.

6. Health, Safety & Safeguarding

6.1 The health and safety of all children and families is our highest priority. Kinder Island meets its obligations under the Health and Safety at Work etc. Act 1974 and associated regulations.

6.2 Kinder Island takes all reasonable steps to maintain a safe environment for all visitors. Guests are asked to follow all safety guidance and staff instructions at all times.

6.3 Kinder Island reserves the right to refuse entry to any child showing signs of illness, to protect the wellbeing of all visitors.

6.4 Kinder Island is committed to safeguarding the welfare of all children. Staff have been trained in safeguarding in accordance with relevant legislation, including the Children Act 1989 and Working Together to Safeguard Children (2023). Any safeguarding concerns will be reported to the appropriate authority.

6.5 A qualified first aider is present during all sessions. Emergency procedures are in place and reviewed regularly.

6.6 Risk assessments are conducted and reviewed for all activities and equipment used at the Venue.

7. Behaviour & Shared Space Etiquette

7.1 Kinder Island is a shared community space. All guests are expected to treat staff, other visitors, and shared equipment with courtesy and respect.

7.2 Behaviour that compromises safety or significantly disrupts activities may result in removal from the session. No refund will be issued in such circumstances, unless required by law.

8. Photography & Media

8.1 Parents and guardians are welcome to photograph or film their own child for personal use. Please ensure other families are not captured without their consent.

8.2 Kinder Island may occasionally take photos or videos for marketing or documentation purposes. These will only be used with parental consent. Please inform our team on arrival if you prefer not to be included.

8.3 The use of any imagery is governed by our Privacy Policy and is in accordance with UK GDPR and the Data Protection Act 2018.

9. Personal Belongings

9.1 Guests are responsible for their own personal belongings throughout the visit.

9.2 Kinder Island accepts no liability for items that are lost, stolen, or damaged on the premises.

9.3 We recommend leaving valuables at home or in a locked vehicle.

10. Food, Drink & Allergens

10.1 If Kinder Island provides or sells food or drink on the premises, full allergen information will be made available in accordance with the Food Information Regulations 2014 and Regulation (EU) No 1169/2011 (retained in UK law).

10.2 Parents are responsible for informing staff of any known allergies or dietary requirements before their child consumes any food provided at the Venue.

10.3 Kinder Island does not permit outside food or drink to be brought into the Venue, with the exception of home-made baby food appropriate for young children. Please take all waste away with you or dispose of it in the bins provided.

11. Data Protection & Privacy

11.1 Kinder Island processes personal data in accordance with UK GDPR and the Data Protection Act 2018.

11.2 We collect and use personal data for the following purposes:

  • Processing and managing bookings

  • Communicating session information and updates

  • Safety records and safeguarding obligations

  • Marketing communications (only with your explicit consent)

11.3 The lawful bases for processing are: contractual necessity (booking management), legal obligation (safeguarding), and legitimate interests or consent (marketing).

11.4 Your data will not be sold or shared with third parties except where required by law or necessary to provide the service (e.g. payment processors).

11.5 You have the right to: access your data, correct inaccuracies, request deletion, withdraw consent, and lodge a complaint with the Information Commissioner's Office (ICO) at ico.org.uk.

12. Complaints

12.1 Kinder Island is committed to resolving concerns promptly and fairly.

12.2 If you are dissatisfied with any aspect of your experience, please speak to a member of staff at the time, or contact us by email at hello@kinderisland.co.uk.

12.3 We aim to acknowledge all complaints within 2 working days and provide a full response within 10 working days.

12.4 If your complaint is not resolved to your satisfaction, you may seek further advice from the Citizens Advice Bureau or your local Trading Standards office.

13. Changes to Terms

13.1 Kinder Island reserves the right to update these Terms at any time. The latest version will always be published on our website.

13.2 Continued use of our services following any update constitutes acceptance of the revised Terms.

14. Governing Law

14.1 These Terms are governed by the laws of England and Wales.

14.2 Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
